Charges Filed in Montana Case

CBS Montana reported today that:

A Ballantine woman faces two counts of felony animal cruelty and other charges after two raids on her dog breeding operation last month.

Yellowstone County Attorney Dennix Paxinos says 59-year-old Linda Kapsa also faces four misdemeanor charges stemming from the raids on Dec. 11 and Dec. 30. Investigators say Kapsa failed to properly care for the dogs, which she sold over the internet.


The felony charges each carry a maximum penalty of 2 years in jail and a fine of up to $2.5 million.

Paxinos says Kapsa could be arraigned as soon as Tuesday.

That $2.5 million published by CBS is not correct.  Thanks to Mary Peaslee who directs us to Montana statutes:

“Aggravated cruelty to animals is defined as: “purposely or knowingly: kills or inflicts cruelty to an animal with the purpose of terrifying, torturing, or mutilating the animal; or inflicts cruelty to animals on a collection, kennel, or herd of 10 or more animals.” Aggravated animal cruelty or a second or subsequent conviction of animal cruelty is punishable with a fine up to $2,500 and/or imprisonment up to 2 years. Additional sentencing provisions include cost of care including those costs incurred by animal control or humane society, forfeiture of animals, and prohibited ownership, possession or custody of animals for a term determined by the court. “

    How did they get from $2500 to $2.5 million? That’s some wild n’ crazy decimal point work.
